James Smith enters plea deal

ALPENA — James Smith, 45, entered a plea deal in the 26th Circuit Court in Alpena on Monday.

Smith had nine charges total. Four of those charges are child sexually abusive material aggravated possession, three are using computers to commit a crime, and the last two are child sexually abusive activity aggravated distributing or promoting and aggravated producing of child sexually abusive activity or material.

Smith pleaded guilty to aggravated producing of child sexually abusive activity or material, one count of using computers to commit a crime, child sexually abusive activity aggravated distributing or promoting, and two of the four counts of child sexually abusive material aggravated possession, according to MiCourt case search. The other charges were dismissed.

The plea still allows Smith to be sentenced to the maximum amount of time as if he were convicted of all the charges, Alpena Prosecuting Attorney Cynthia Muszynski said in a text. Aggravated producing of child sexually abusive activity or material carries a maximum sentence of 25 years in prison.

Smith’s sentencing will be on Nov. 17.
