Court denies Agar’s appeal
An Alpena man accused who was convicted of first-degree criminal sexual conduct- sexual penetration of a person under 13 years of age and being a habitual offender was denied his appeal by the Michigan Appeals Court on Thursday.
Todd Allen Agar was found guilty of the crimes in 2022 and was sentenced to 38-75 years in prison.
The appeals court said Agar failed to show that he did not receive a fair trial or that the verdict is not worthy of confidence based on his complaints regarding the bill of particulars and police report. The state court also ruled that Agar did not prove that some evidence in the case was suppressed.
