Alpena sex assault case delayed

ALPENA — Alpena County Circuit Court Judge Ed Black on Monday delayed Thomas VanDuinen’s criminal sexual conduct case until after the conclusion of VanDuinen’s federal trial on similar charges.

The Alpena sex assault case already was delayed until after another case against VanDuinen — in which the Alpena man faced charges of making false claims against police — wrapped up.

In that case, a jury on Thursday found VanDuinen guilty of three counts of false report of a felony, one count of lying to a peace officer, and one count of using a computer to commit a crime for false statements. Prosecutors said VanDuinen made several false accusations against Michigan State Police troopers who searched VanDuinen’s property as part of the sex assault investigation. VanDuinen is expected to be sentenced in that case on Aug. 19.

Now in Alpena County, VanDuinen faces one count of first-degree criminal sexual conduct during a felony, three counts of aggravated child sexually abusive activity, two counts of using a computer to commit a crime, and accosting and soliciting prostitution.

Meanwhile, in federal court, VanDuinen faces one count of sexual exploitation of a minor.

During a status conference in the Alpena court on Monday, VanDuinen, who appeared in court via videoconference, waived his right to a speedy trial and agreed to push back any further proceedings until after his federal trial, currently slated for Oct. 23 and 24.

Black set VanDuinen’s next hearing in the Alpena court for Nov. 4.

The State Police began investigating VanDuinen three years ago after an alleged victim claimed VanDuinen preyed on young girls, provided illegal drugs to them, and forced them to have sex with him.

Detectives recovered countless images and videos of child sexually abusive material during their search of VanDuinen’s property.

Police say VanDuinen also made child sexually abusive materials and used social media to reach out to young girls.

Also in court on Monday:

∫ David Lozano was sentenced to three to 20 years of incarceration, with credit for 45 days, after pleading guilty to two counts of possession of methamphetamines with intent to deliver.

∫ Sean Gentile was sentenced to 48 months to 15 years of incarceration, with credit for 192 days, after pleading guilty to one count of criminal sexual conduct in the third degree after having sexual contact with a 14-year-old girl.

∫ Danielle Robillard was sentenced to three to 20 years of incarceration, with credit for 93 days, after pleading guilty to two counts of possession of methamphetamines with intent to deliver.
