Alpena man faces home invasion, drug use charges

ALPENA — A 41-year-old Alpena man, Shane Tomcheck, is facing charges related to allegations he broke into a home while under the influence.

His case was on Wednesday bound over to 26th Circuit Court.

Tomcheck’s charges currently consist of one count of first-degree home invasion, use of methamphetamines, and malicious destruction of personal property.

During the probable cause hearing, Alpena County Prosecutor Cynthia Muszynski called up the alleged victim, Alpena resident Hunter Nichol, who recounted that Tomcheck allegedly broke into his residence while he was home alone, forcing Nichol to retrieve his shotgun and demand that Tomcheck leave his house at gunpoint.

“I heard the back door get kicked open,” Nichol said. “So I run up the stairs and get my shotgun out of my safe, turn around, and point it at him.”

Muszynski also called up a trooper from the Michigan State Police who recounted hearing Tomcheck admit that he intended to hurt Nichol when he entered.

After the witnesses were called, 88th District Court Judge Alan Curtis ultimately found that there was probable cause for first-degree home invasion and thus bound Tomcheck’s case to the circuit court.

“You have here Mr. Nichol told me he was afraid that somebody was breaking into his house to the point that he told his parents to have to call the police and he went to pull out a shotgun,” Curtis said. “The court will be bound over on count one.”
