Alleged kidnapper appears in court

ALPENA — A 17-year-old Alpena male must wait a little longer to find out whether or not he will be tried as an adult after an alleged kidnapping attempt earlier this month.

On Wednesday in Alpena’s 88th District Court, Noah Adkins’ defense lawyer filed for dismissal of his case due to procedural issues of trying him as an adult.

Adkins was arraigned last week on one count of attempted kidnapping/child enticement, one count of attempted assault to do great bodily harm less than murder, and one count of assault and battery.

Despite only being 17, Adkins was automatically charged as an adult during his court appearance last week. Adkins’ attorney revealed during Wednesday’s probable cause conference that Adkins’ charges didn’t meet the requirements necessary for an immediate trial as an adult.

According to the defense, Adkins must first be tried in family court, where it will be determined whether or not he will be tried as an adult. The prosecution has already made a submission.

According to a news release by the Michigan State Police, Adkins approached an eight-year-old girl in her backyard on May 10 and attempted to restrain her by covering her mouth. The alleged victim managed to break free and escape and the alleged victim’s 13-year-old brother, who witnessed the assault take place, shot the assailant in the head and chest with a slingshot.

Upon their arrival, Michigan State Police-Alpena Post troopers canvassed the area and found Adkins hiding at a nearby gas station and took him into custody. Police identified him as the assailant by the wounds on his head and chest. While in custody, he ultimately confessed that his plans were to severely beat the alleged victim.

During Wednesday’s conference, the prosecution requested that the alleged victim’s address, phone number, and contact info be redacted from any police reports shared with the defense. The defense agreed to this request.

Adkins’ next scheduled court date is May 24.
