ALPENA ― A judge denied an Alpena man the shorter sentence he wanted after a jury in 2017 convicted him of a 2005 rape.
The Michigan Court of Appeals in 2019 threw out one charge against Thomas Guthrie, 53, and sent the case back to the Alpena court for resentencing.
On Friday, Judge Jason Elmore, of Wexford County but presiding over the Alpena County case, sentenced Guthrie to 20 to 50 years in prison ― the same as Guthrie's original sentence ― on the remaining charge.
Guthrie could appeal the reimposed sentence, defense attorney Bill Pfeifer said.
Originally scheduled in July 2019, the resentencing has been delayed for more than two years because of pending appeals to higher courts, COVID-19 restrictions, and motions filed by the defendant.
