Accused child rapist charged with child porn possession

ALPENA — Todd Allen Agar, who is fighting charges of sexually assaulting young girls in Alpena’s 26th Circuit Court, has now been accused of possession of child pornography in a downstate court.

Fifteen images depicting minors in sexually suggestive positions were found on Agar’s phone, according to charges filed against him in a Genesee County court this week.

The phone was seized in 2018 after a parole officer was tipped off that Agar — who, at the time, was free on parole related to drug-related charges — had been charged in Alpena with sexual assault.

In Alpena courts, Agar is accused of coercing two 14-year-old girls into having sex with him and raping an 11-year-old between 1998 and 2005.

The images found on Agar’s phone do not depict his alleged victims in the Alpena case, according to Sgt. David Vergison of the Michigan State Police Computer Crimes Unit.

Information taken from Agar’s phone does not show specific evidence of searches for child pornography, although that information isn’t always available from a phone examination, Vergison said.

“Clearly, if you have internet-related, downloaded child pornography on your phone, in some fashion you were searching it,” Vergison said.

Agar, who has requested a transfer to the Alpena County Jail until his case goes to trial, is currently housed at a prison in Jackson, in quarantine after a brief transfer to Alpena to meet with his attorney.

Agar would probably have been arrested on the child pornography charges many months ago if the coronavirus hadn’t slowed down some court and police work, Vergison said. When that happened, investigations concerning people who were not incarcerated or those awaiting sentencing took priority.

“We knew Mr. Agar wasn’t going anywhere any time soon,” Vergison said, “It was put into a pile to be reviewed when there was time.”

Agar was arraigned on the child porn charges in Genesee County on Tuesday. He is next scheduled to appear in Alpena courts, facing the sexual assault charges, on Dec. 7.
