Kinser has prelim exam for murdering brother

ATLANTA — The preliminary examination for Mark Kinser was Thursday in 88th District Court. Kinser is charged with open murder for killing his brother, Brian Kinser, in the early morning hours April 21 at a residence in Briley Township.

Testimony was given by Deputy Daniel Loder, Detective Sgt. Jennifer Pintar, and Detective Sgt. David Hart about what happened on April 21. Loder was one of two deputies who arrived at the residence after a 911 call was made. Pintar is the lead investigator for the case, and Hart has assisted her throughout the case.

Mark Kinser wrote a statement saying he was playing his guitar when a discussion between the brothers about his guitar playing took place. The discussion turned into an argument and the two were wrestling on the floor. Brian Kinser then ran into the living room of the residence where Mark Kinser shot him in the head. Both were drinking the night of the incident.

Pintar said she didn’t question Mark Kinser until later in the day on April 21 because she wanted his sobriety to improve before asking him any questions.

Prosecutor Vicki Kundinger said Loder’s testimony and the autopsy of Brian Kinser proves probable cause that Mark Kinser killed his brother. The autopsy showed that Brian Kinser had multiple gunshot wounds to the head.

Probate Judge Benjamin Bolser said a crime was committed and there is probable cause for the case to move forward. Bolser said moving the case forward is based primarily on the testimonies of Loder and Pintar and the written statement from Mark Kinser.

The case was bound over to 26th Circuit Court for arraignment on June 25 at 1:30 p.m.
