No plea deal for downstate deputy

ATLANTA –An attempt to reach a plea deal for a downstate sheriff’s deputy facing drunk driving charge from an incident in November was unsuccessful on Friday.

Brian Filipiak appeared in 88th District Court for a pretrial hearing after being arrested for a super drunk driving charge in November.

Appearing with his attorney Timothy Arner, the defense asked to talk in the judge’s chamber with Assistant Prosecutor Bradley Nichols before proceeding with the hearing.

Upon returning from the conference, the defense and prosecution could not agree on a plea deal and court proceeded with the pretrial.

The prosecution asked for a defense disclosure to be filed of which Arner asked the court for a 30 day period to present one. Judge Ben Bolser denied the request and gave the defense a 14 day period to submit the disclosure.

Filipiak is a lieutenant in the Washtenaw County Sheriff Department who was arrested on Nov. 13 in Montmorency County for suspicion of drunk driving. The bodycam from Deputy Zach Morrison shows Filipiak pleading with Morrison to sleep it off and not being cooperative with the deputies commands.

Filipiak was only arraigned on one charge from the incident which Morrison did garner his taser before Filipiak ultimately obeyed his commands. He was charged with operating while intoxicated with a blood alcohol content of .17 or more.

According to an MLive report, Filipiak is on unpaid administrative leave from his position.

With no plea deal being reached, a status conference is scheduled for Jan. 27 and bond was continued.
