ALPENA - James William Freese Jr. was arraigned in 88th District Court Monday on 12 charges alleging sexual assault on teenagers, including at least one under the age of 13, spanning more than a decade.
His father, James William Freese, 58, and brother, Andrew Joseph Freese, 29, also face similar charges.
The assaults took place in Maple Ridge and Alpena townships from 1990 to 2012.
According to court records, the father and Andrew Freese were arraigned Oct. 28 before 88th Judicial District Court Judge Theodore Johnson.
Based on complaint documents provided by Alpena County Prosecutor Ed Black, James Freese faces five counts, including one alleging he had sex with a girl under 13 years of age in 1990. Freese is related by affinity to at least one victim, and is out on a $100,000 cash surety bond.
A resident of Engadine, he will be back in court for a preliminary hearing 9:30 a.m. Nov. 7. If convicted, the charges carry a maximum sentence of 10 to 15 years in prison. He also must be tested for AIDS and other sexually transmitted diseases.
Andrew Freese, of Spring Hill, Fla., faces two charges from September 2002 in which is his accused of assault with intent to commit sexual penetration and criminal sexual assault on a child under 13. He also returns to court Nov. 7 and is out on a $35,000 cash surety bond. He faces 10 to 15 years in prison if convicted, and will be required to undergo testing.
James Freese Jr. of Engadine turned himself in to authorities and remains in custody, an Alpena County Jail officer said Monday, and must come up with $100,000 in cash to bond out.
According to the complaint he allegedly committed criminal sexual conduct on victims under the age of 13 in 1992, 2010 and 2012. Other assaults involved older children, and the prosecutor's office is alleging force was used.
The charges carry terms of two years to life in prison and mandatory testing, if he is convicted. His preliminary hearing will be Nov. 13 before Johnson.
