Kinser murder trial set for Feb. 11

ATLANTA — Mark Kinser, who is accused of murdering his brother in April, will go on trial Feb. 11.

Judge Michael Mack scheduled the trial during a hearing on Wednesday in 88th District Court. He also scheduled a status conference for Jan. 14 to allow both parties to update the case if needed before trial.

Mack also gave Defense Attorney William Weise and Prosecuting Attorney Vicki Kundinger 21 days to file written arguments regarding the case before the trial begins.

Mack said if any more motions need to be filed and heard by either party, he wants them filed by the end of January so they can be heard before the trial.

On Wednesday, it was stated that physical evidence including DNA, blood, tissue and electronics have been recorded for the case, but there has not been a record completed for the ballistics from the night of the murder.

Kundinger and Weise questioned Montmorency County Sheriff’s Department Deputy Daniel Loder, Detective Sgt. Jennifer Pintar, and Detective Sgt. David Hart about the case. Loder was one of two deputies who arrived at the Briley Township residence after a 911 call was made while Pintar is the lead investigator for the case, with Hart assisting her.

Body cam footage was presented to the court that showed what happened when Loder and the other deputy arrived at the residence until EMS personnel arrived and attended to Brian Kinser, who had been shot.

Mark Kinser wrote in a statement that he and his brother, Brian Kinser, were arguing and wrestling in a residence in Briley Township in the early morning hours of April 21 when Mark Kinser shot Brian Kinser in the head. Both were drinking that night. Despite the written statement, Mark Kinser has not entered a formal guilty plea to an open murder charge.

An autopsy showed that Brian Kinser suffered multiple gunshot wounds to the head.
