City appeals water ruling

After a lengthy closed session on Monday, the Alpena Municipal Council voted 5-0 to file an appeal of its own over the ongoing water and sewer litigation with Alpena Township.

Last month, the township voted to appeal a portion of 26th Circuit Court Judge Michael Mack’s Sept. 19 order, which divvied up money from an escrow account that was established when the township refused to pay the full cost of a water rate increase imposed by the city.

The litigation is nearing its fifth year and the two sides have spent a combined more than $2 million on attorney and consultant fees.
