Results find Boldrey not legally insane

ATLANTA — Kyle Boldrey appeared in circuit court Monday for a status conference after legal council received back the forensic center results stating he was not legally insane during a double homicide he is alleged to have committed.

The charges stem from an incident that occurred in the early morning hours of Aug. 27 when Boldrey allegedly took the life of two others while severely injuring two more. Boldrey was apprehended by officers after being tased multiple times walking along the road in Hillman.

Boldery was charged with two counts of open murder; two counts assault with intent to murder; one count of home invasion; and two counts of resisting and obstructing a police officer.

In late October Boldrey was bound over to circuit court on all seven charges.

Multiple status conferences have been postponed since then as legal council were awaiting the results of the forensic report from the Center for Forensic Psychiatry. On Friday the defense and prosecution received them, which argued Boldery was not legally insane.

“It is clear from the results that the statutory requirements for legal insanity have not been met in this report,” Judge Michael Mack said.

Boldrey’s defense team, Dan White and Matt Wojda, told the court it already was in the process of having an additional psychological examination performed. In addition the defense also will be using an expert witness, whose expertise includes the synthetic drug that was used during the episode, for their defense.

Mack scheduled one last status conference on June 12 before the case is scheduled to go to trial on July 31. Mack told the attorneys he would like to abide by these hearing dates.

Boldrey remains lodged at the Montmorency County Jail without bond.
